New York’s abortion law has not met constitutional standards for more than four decades.
Unless it's immediately life-saving, getting an abortion after 24 weeks is a criminal act under New York law — even when it's necessary for a woman's health or when a fetus is not viable. That not only falls short of what Roe v. Wade requires, but it results in devastating denials of care. Women must travel out of state for care or wait until their health deteriorates during pregnancy to the point that their lives are in jeopardy.
With reproductive rights under attack at the federal level, New York must act. The Trump administration seeks to overturn Roe v. Wade and repeal regulations under the Affordable Care Act that mandate coverage of contraception without a co-payment.
New York must pass the Reproductive Health Act and the Comprehensive Contraceptive Coverage Act. Our state should bring abortion out of the criminal code and put it in the public health law where it belongs, and should require that insurers offer contraceptive coverage without co-payment to all New Yorkers.
