New educational content is what awaits attendees of August Mack’s 2nd FREE Environmental Risk Educational Forum on Tuesday, July 17th from 9:00 AM – 11:30 AM at the Riverside Plaza Center in Chicago. The forum is open to all, but attending attorneys will receive two CLE credits at no cost. In addition, a free continental breakfast will be served starting at 9:00 AM, with the first presentation starting at 9:15 AM.

The Importance of Evaluating Environmental Compliance During Traditional Environmental Due Diligence: Traditional Environmental Due Diligence typically consists of a Phase I and II Environmental Site Assessment. The goal of the Phase I/II is to identify and quantify environmental liabilities associated with the real estate. In some situations, like Private Equity investment or Mergers and Acquisitions, the “deal” also includes the purchase and continued operation of the business that occupies the real estate. In this situation, how important is evaluating the environmental compliance of the business to the bank or investment group? Should it be important? Many times the cost of environmental liabilities associated with non-compliance can well exceed the costs associated with Phase I and Phase II findings. Since environmental compliance is not a scope item in a typical Phase I, this presentation will discuss those aspects of a deal that often get overlooked and strategies to incorporate operational compliance into traditional environmental due diligence.  

The PCE Story – An Interesting History of a Common Contaminant: Tetrachloroethylene, also known as Perchloroethylene, PERC or PCE, has been a frequently used chlorinated solvent in the United States. Although PCE has had many uses including degreasing, consumer products and painting, it is most known for its use in dry cleaning. Therefore, PCE is often referred to as dry cleaning solvent. Unfortunately, PCE’s widespread use has resulted in releases of PCE to the environment. The characteristics of PCE make it difficult to find when it is released to the environment resulting in expensive and complex investigation and possibly cleanup. Migration and exposure to contamination often results in legal actions so it is important that real estate professionals have a general understanding of common contaminants including their history, uses, migration in the subsurface and exposure risks. This informative presentation will provide information on the chemistry, history, production, and uses of PCE in the U.S. and why PCE is such a troubling contaminant in the environment.
