To Disclose or Not to Disclose?

This is often one of the most challenging decisions a realtor can be faced with. This class is not an agency course, so the disclosures regarding brokerage relationships, dual/designated agency and limited service agency will not be discussed. We will look at what substantive disclosures are required to be made to one's own client as well as to other parties to a transaction. We will discuss the "Five Prong Test" that can be used to help determine your disclosure obligations and we will take a look at some interesting recent case law on the topic.
