If you're a nonimmigrant you can possibly change your F-1 OPT status to H-1B cap exempt category by creating a startup and maintaining a relationship with NONPROFIT APPLIED RESEARCH ORGANIZATION INC.

Iniitial fee of $1,500 is for Corporation Registered Agent, business address at 1390 Market Street, SF, CA and virtualmail services for 1-year.

9 FAM 41.31 N9.2 (CT:VISA-701; 02-15-2005) authorizes foreign nationals can enter the USA on a B-1 Business Visitor Visa as Members of Board of Directors of U.S. Corporation: An [foreign national] who is a member of the board of directors of a U.S. corporation seeking to enter the United States to attend a meeting of the board or to perform other functions resulting from membership on the board.  Use NONPROFIT APPLIED RESEARCH ORGANIZATION INC as the corporate registered agent and mail in the registration form to the California Secretary of State.

$10,500 for each year is due upfront prior to your startup company submitting the Labor Condition Application (LCA)

for "employment at" a location controlled and supervised by NONPROFIT APPLIED RESEARCH ORGANIZATION INC.

NOTE: Max is three (3) years. Therefore, $31,500 would be due upfront for a 3-year relationship. Fee is subject to change.

Prior to submitting the USCIS Form I-129, once the LCA is approved, the startup is required to submit payment to NONPROFIT APPLIED RESEARCH ORGANIZATION INC. for physical office space in a metropolitation statistical area (MSA) in the State of California.  The payment must include all necessary fees for deposit, insurance, supervision fee (at least 20 hours per week), and monthly lease/rent and other requirements specifiied by law.  The company is responsible for meeting thes standards for prevailing wage and benefits.
